End User License Agreement (EULA)

App: Sketch2Diagram for Confluence Vendor: Appgenesis Effective Date: August 9, 2026

This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Appgenesis ("Vendor") for the Sketch2Diagram for Confluence application ("App").

By installing or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the App.

1. Grant of License

Vendor grants you a revocable, non-exclusive, non-transferable, limited license to install and use the App on your Atlassian Confluence instance strictly in accordance with the terms of this Agreement and the Atlassian Marketplace Terms of Use.

2. Restrictions

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App.
• Copy, modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.
• Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Vendor or its affiliates.

3. Intellectual Property

The App, including all intellectual property rights therein, is the exclusive property of Appgenesis.

4. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. VENDOR DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR THAT OPERATION OF THE APP WILL BE UNINTERRUPTED.

5. Limitation of Liability

IN NO EVENT SHALL VENDOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF BUSINESS, LOST PROFITS, LOSS OF DATA, OR CORRUPTION OF DATA) ARISING OUT OF OR RELATING TO THIS EULA OR THE APP, HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY, EVEN IF VENDOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Third-Party Services

The App relies on third-party services, specifically the Google Gemini API. Vendor is not responsible for any downtime, latency, or issues arising from these third-party services.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, without giving effect to any principles of conflicts of law.
